, : The decision for acupuncture treatment an expansion of the right of privacy. American Journal of Acupuncture 10(3): 215-226

In Andrews vs. Ballard the USA District Court for the Southern District of Texas held that the right to receive acupuncture treatments is among those personal rights deemed fundamental, and that the Texas Medical Practice Act unconstitutionally interferes with the plaintiff's right of privacy. Although the rules and statutes in question do not prohibit the practice of acupuncture, the plaintiffs claimed that this treatment was virtually eliminated by the physicians-only requirement. This case expands the constitutional right of privacy, a right the Supreme Court deems fundamental.
