The Ontario Supreme Court removed an adolescent minor from the custody of his divorced mother after she refused on religious grounds to permit him to receive blood transfusions for serious injuries sustained in a traffic accident. The natural father was reached in time, however, and did consent to the transfusions. The court reasoned that, because a child has the right to life and to the best available medical care, willful withholding of medical care constitutes neglect. Custody of the minor was awarded to the maternal grandmother, who assured the court that she would give her consent to all essential medical treatment.
